Terms of Service

Welcome to Tangerine Intelligence. These Terms of Service ("Terms") govern your use of all apps, websites, and services operated by Tangerine Intelligence, Inc. ("Tangerine," "we," "us," or "our"). Please read these Terms carefully before using our services.

1. Acceptance of Terms

By signing in with Google or Apple, downloading any Tangerine app, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These two documents together govern your relationship with Tangerine Intelligence. If you do not agree to these Terms, do not use our services.

2. The Tangerine Platform

Tangerine Intelligence, Inc. operates multiple consumer apps as a unified platform. These apps share a common account system and infrastructure. Key things to understand:

• Your account works across all current and future Tangerine apps.
• Data from all Tangerine apps you use is processed together under these Terms.
• These Terms apply equally to every app in the Tangerine ecosystem.
• We may add new apps to the platform at any time, and these Terms will apply to those apps as well.

3. Age Requirement

You must be at least 18 years old to use any Tangerine app. By creating an account, you represent and warrant that you are 18 years of age or older. We do not knowingly collect data from or provide services to individuals under 18. If we learn that a user is under 18, we will terminate the account and delete associated data.

4. Account

Tangerine uses Google Sign-In and Apple Sign-In exclusively. We do not offer custom account creation, usernames, or passwords. When you sign in, you agree to:

• Use your authentic Google or Apple account.
• Maintain the security of the Google or Apple account linked to your Tangerine account.
• Accept responsibility for all activity that occurs through your account.
• Notify us immediately if you believe your account has been compromised.

Because authentication is handled entirely by Google or Apple, your sign-in security depends on the security of those accounts. We strongly recommend enabling two-factor authentication on your Google or Apple account.

5. Data License Grant

This section describes how we use anonymized behavioral data. Please read it carefully.

By using any Tangerine app, you grant Tangerine Intelligence, Inc. a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to:

1. Collect, process, and anonymize your behavioral data across all Tangerine apps you use, including usage patterns, interaction data, and feature engagement.
2. Combine anonymized data from multiple apps into unified behavioral datasets that reflect cross-app patterns and trends.
3. Train machine learning models on anonymized, aggregated data to improve our services and develop new products.
4. Create and sell de-identified, cohort-level intelligence products to enterprise clients, including behavioral trend reports, market research insights, and demographic analyses.
5. License anonymized, aggregated behavioral datasets to third parties, including AI companies, research institutions, and data analytics firms.

Important protections and limitations:

• Anonymized data only. This license applies exclusively to anonymized, de-identified data — never to personally identifiable information. All data is irreversibly anonymized on your device before it is transmitted to our servers.
• No individual-level data sharing. No enterprise client, third party, or data licensee ever receives individual-level data. All intelligence products and datasets are based on aggregated cohorts.
• Minimum cohort size. We enforce a minimum cohort size of 30 users for any intelligence product, dataset, or analysis shared externally. This prevents the possibility of identifying individuals from small group data.
• Survives account deletion. Because anonymized data cannot be traced back to you, this license survives account deletion for data that has already been anonymized. Once data is irreversibly anonymized, it is no longer your personal data and cannot be retrieved or deleted.

6. User Content

Some Tangerine apps allow you to create, upload, or share content such as posts, photos, reviews, and profiles ("User Content"). You retain full ownership of your User Content.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content within the Tangerine apps for the purpose of operating and providing our services. This license ends when you delete your User Content or your account, except for copies that other users may have saved or shared within the apps.

We may analyze anonymized patterns derived from User Content (for example, aggregate trends in review sentiment or posting frequency) as part of our intelligence products. However, we will never share your individual User Content with enterprise clients or third parties outside the Tangerine platform.

You represent that you own or have the necessary rights to submit your User Content and that it does not violate any third party's rights.

7. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use our services for any illegal or unauthorized purpose.
• Harass, abuse, threaten, stalk, or intimidate other users.
• Post content that is defamatory, obscene, hateful, or promotes violence.
• Engage in fraud, impersonation, or misrepresentation of your identity.
• Attempt to gain unauthorized access to our systems, other users' accounts, or any part of our infrastructure.
• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code, algorithms, or data models of our apps.
• Use automated systems (bots, scrapers, crawlers) to access our services without our written permission.
• Interfere with or disrupt the operation of our services or the servers and networks connected to them.
• Upload or transmit viruses, malware, or any other malicious code.
• Collect personal information about other users without their consent.
• Use our services to send spam, chain letters, or unsolicited promotions.
• Attempt to circumvent any content moderation, rate limiting, or security measures.

We reserve the right to suspend or terminate your account if you violate these Terms.

8. Premium Subscriptions

Some Tangerine apps offer optional premium features through paid subscriptions. Regarding premium subscriptions:

• Free tier. All Tangerine apps provide full core functionality at no cost. Premium subscriptions unlock additional features and enhanced experiences.
• Pricing. Premium subscription prices range from $4.99 to $8.99 per month, depending on the app. Current pricing is displayed in each app and in the App Store or Google Play Store.
• Auto-renewal. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• Cancellation. You may cancel your subscription at any time through the Apple App Store or Google Play Store. Cancellation takes effect at the end of the current billing period.
• No refunds. We do not provide refunds for partial billing periods. If you cancel mid-month, you will retain access to premium features until the end of your current billing period.
• Price changes. We may change subscription prices with at least 30 days' notice. Price changes will apply to the next billing period after the notice period.

9. Privacy

Your privacy matters to us. Our Privacy Policy explains in detail how we collect, use, store, and share your information. The Privacy Policy is incorporated into these Terms by reference.

By using any Tangerine app, you consent to the data practices described in both these Terms and our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding data practices, these Terms shall control.

10. Intellectual Property

All apps, software, algorithms, machine learning models, intelligence products, proprietary behavioral metrics, content, features, design, trademarks, and trade secrets are owned by Tangerine Intelligence, Inc. and are protected by United States and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use our apps for your personal, non-commercial use, subject to these Terms. This license does not include the right to:

• Modify or create derivative works based on our services.
• Reproduce, distribute, publicly display, or publicly perform any part of our services.
• Use any data mining, robots, or similar data-gathering methods.
• Use the Tangerine Intelligence name, logo, or branding without our written permission.
• Attempt to access, extract, or reverse-engineer our behavioral models, intelligence products, or proprietary metrics.

11. Health and Wellness Disclaimer

Tangerine apps are not medical devices and do not provide medical advice, diagnosis, or treatment.

Certain Tangerine apps include health and wellness features such as energy scores, sleep analysis, voice biomarkers, mood tracking, HRV analysis, and food insights. These features are for informational and educational purposes only. Specifically:

• Health and wellness features are not a substitute for professional medical advice, diagnosis, or treatment.
• You should not make medical decisions based on information provided by our apps.
• Health-related insights are generated by algorithms and are not reviewed or validated by licensed healthcare professionals.
• Results may not be accurate or applicable to your specific health situation.

Always consult a qualified healthcare provider with any questions about a medical condition. Never disregard professional medical advice or delay seeking it because of information provided by our apps.

If you are experiencing a medical emergency, call your local emergency services immediately.

12. Disclaimers

Our services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that our services will be uninterrupted, timely, secure, or error-free.
• Any warranty regarding the accuracy or reliability of any information obtained through our services.
• Any warranty regarding the accuracy, completeness, or usefulness of health and wellness insights.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Tangerine Intelligence, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with:

• Your use of or inability to use our services.
• Any errors, mistakes, or inaccuracies in content or health-related insights.
• Unauthorized access to or alteration of your data.
• Any third-party conduct on our services.
• Decisions you make based on information provided by our apps.
• Any other matter relating to our services.

In no event shall our total aggregate liability to you exceed the greater of (a) the total amount you paid to Tangerine Intelligence in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred dollars ($100).

14. Indemnification

You agree to indemnify, defend, and hold harmless Tangerine Intelligence, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of our services, your User Content, or your violation of these Terms.

15. Termination

By you: You may delete your account at any time through your account settings in any Tangerine app or by contacting us at legal@tangerineintelligence.ai. Upon account deletion, we will process data deletion in accordance with our Privacy Policy. As described in Section 5, data that has already been irreversibly anonymized cannot be deleted because it can no longer be associated with your account.

By us: We may suspend or terminate your access to our services at any time, with or without notice, for reasons including but not limited to:

• Violation of these Terms or our Acceptable Use policy.
• Conduct that is harmful to other users, us, or third parties.
• Requests by law enforcement or government agencies.
• Discontinuation of any Tangerine app or service.

Upon termination, your right to use our services will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including the data license grant, intellectual property, disclaimers, limitation of liability, and indemnification.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in the State of Delaware.

17. Dispute Resolution

Before filing a legal claim, you agree to try to resolve the dispute informally by contacting us at legal@tangerineintelligence.ai. We will attempt to resolve the dispute informally within 30 days. If the dispute is not resolved informally, either party may proceed with formal legal action as described above.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make changes:

• We will update the "Effective date" at the top of this page.
• For material changes, we will notify you via in-app notification at least 30 days before the changes take effect.
• Your continued use of any Tangerine app after the updated Terms take effect constitutes your acceptance of the changes.
• If you do not agree to the updated Terms, you must stop using our services and delete your account.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tangerine Intelligence, Inc. regarding your use of our services, and supersede all prior agreements and understandings, whether written or oral.
